An LPA enables someone a client trusts to manage their affairs and make decisions should they become unable to. There are two types of Lasting Power of Attorney for the different aspects of a clients life and these are Property & Affairs and Health & Welfare.

Who needs an LPA?
Commonly people consider making a Lasting Power of Attorney when they have lost mental capacity. However, at this stage it would in fact be impossible to do so and should always be prepared well in advance of need. An unforeseen accident or illness can happen at any time of life and could impact someone’s ability to make decisions. Accessing someone’s finances in these situations can be a complex and protracted process without having attorneys appointed.
The spouse can deal with everything can’t they?
This is a common misconception as a spouse or partner in fact has no automatic rights or authority to look after another persons affairs if they become unable to. Without a Lasting Power of Attorney, bank accounts (including joint bank accounts) could be frozen causing unpaid bills to accumulate. This could put unnecessary pressure on loved ones at an already stressful time.
What happens if there isn’t a Lasting Power of Attorney in place?
Without a Lasting Power of Attorney in place, it would be necessary to make a formal application to the Court of Protection to appoint a Deputy to look after a persons affairs if they are unable to do so themselves. The decision on who to appoint is a matter for the court and may be a complete stranger rather than a family member. The appointment process is very lengthy and costly meaning putting an LPA in place could not only save emotional strain but also make absolute financial sense.
